The Federal Energy Regulatory Commission (“FERC”) issued an order on January 18, 2024 granting a one-year extension for Transco for its NESE Raritan Bay Gas Pipeline Project.
CHARGE and other activist groups submitted comments urging FERC not to grant an extension based on the fact that despite the granting of a 2-year extension of time in May 2021, Transco has taken no meaningful action that would demonstrate good faith efforts to meet the deadline to complete construction and make the project available for service.
While disappointed that FERC did not deny the extension, it was somewhat gratifying to see that FERC granted the extension for only one year (to May 2024) and not the two years requested by Transco. In its Order, FERC did take into consideration the many arguments put forth by commenters including CHARGE.
